According to the Prosecutor's Office, in 2018 and 2022, state registrars of one of the village councils of the Kremenets district and the City Council made changes to the State Register of Rights to Real Estate. As a result of these actions, the ownership of the church was registered under the Pochaiv Holy Dormition Lavra, although, as the supervisory authority claims, it should be in state ownership according to the law.

The Church of the Nativity of the Most Holy Theotokos, known as the All Saints Church, is located on the territory of the historic monastery cemetery at 43 Lipova Street in Pochaiv and is a monument of national architectural significance. The church was built in 1773 in the late Baroque style with funds from the founder, Mikołaj Potocki.

Earlier, the UOJ wrote that the Supreme Court rejected the DESS's plea to seize the Kyiv Metropolis property and accounts.
